Terms of Service
These terms apply when you use supergayspirits.com, place an order, or join our email or text programs. By using the site you agree to them. If you don't agree, please don't use the site.
Who we are
The site is run by ACF Beverages (d/b/a Supergay Spirits and Two Fruits Cocktails), Brooklyn, New York. "We" and "us" mean ACF Beverages.
You must be 21
You must be at least 21 years old to use this site, buy our products, or join our email or text lists. By using the site you confirm you are 21 or older. We may ask for proof of age before shipping, and an adult 21 or older must sign for delivery.
Orders and checkout
Alcohol sold through this site is sold and shipped by licensed retailers through our checkout partner, AccelPay. When you place an order you are buying from that licensed retailer, and the retailer's and AccelPay's terms also apply to the sale, payment, and shipping. We do not take title to the alcohol or process your payment ourselves.
- Prices and availability can change without notice. If a price is listed incorrectly we may cancel the order and refund you.
- Shipping is limited to states where direct-to-consumer alcohol shipping is allowed. Orders to other states will be cancelled.
- Taxes and shipping are calculated at checkout.
- Merch and non-alcohol items are sold by us directly.
Returns and damaged orders
Alcohol cannot be returned once it has shipped, by law. If your order arrives damaged, leaking, or wrong, email us within 7 days of delivery with a photo and your order number and we will replace it or refund it. Unopened merch can be returned within 30 days for a refund of the item price.
Discount codes and promotions
- One discount code per order, applied at checkout. Codes have no cash value and can't be combined.
- Sign-up credits (for example, a code sent when you join our email or text list) are for new subscribers, one per person, and may expire or be withdrawn at any time.
- We may cancel orders that abuse a promotion, including repeat sign-ups with multiple addresses.
Email and text messages
When you join our email or text list you agree to receive marketing messages from us. Text messages are recurring and automated; message frequency varies and message and data rates may apply. Reply STOP to any text to cancel or HELP for help. Consent to texts is not a condition of purchase. Full details are in our Privacy Policy.
Drink responsibly
Our products contain alcohol. Don't drink and drive. Don't buy for or share with anyone under 21. If you are pregnant, taking medication, or have a health condition, talk to your doctor before drinking.
Our content
Everything on the site, including the Supergay and Two Fruits names, logos, label art, photos, recipes, and text, belongs to us or our licensors. You can share links and screenshots for personal, non-commercial use. Anything else, including reselling our products commercially or using our branding, needs our written permission. Wholesale inquiries go through our wholesale page.
Acceptable use
Don't use the site to break the law, to place fraudulent orders, to scrape or copy our content at scale, to interfere with the site's operation, or to buy alcohol for someone under 21. We can refuse service, cancel orders, or block access if you do.
Third-party links and services
The site links to retailers, delivery apps, social platforms, and our checkout partner. We don't control those sites and aren't responsible for them. Their terms and privacy policies apply when you use them.
Disclaimers and limits on liability
The site and its content are provided as is. We don't promise it will be error-free or always available. To the fullest extent the law allows, we are not liable for indirect, incidental, or consequential damages arising from your use of the site or our products, and our total liability for any claim is limited to the amount you paid for the order in question. Some states don't allow these limits, so they may not apply to you.
Indemnity
You agree to cover us for claims, losses, and costs that come from your misuse of the site, your violation of these terms, or your violation of the law, including providing alcohol to anyone under 21.
Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute that can't be resolved informally will be brought in the state or federal courts in Kings County, New York, and you consent to their jurisdiction. If you have a problem with an order, email us first; we resolve nearly everything that way.
Changes
We may update these terms. The effective date at the top shows when they last changed. Continuing to use the site after a change means you accept the new terms. If any part of these terms is found unenforceable, the rest still applies.
